GoDaddy – Bruksbetingelser for kunstig intelligens

1. Oversikt

Disse bruksbetingelsene («KI-bruksbetingelser») regulerer bruken din av eventuelle tjenester som består av KI-produkter, funksjoner, roboter, agenter, tjenester og/eller verktøy («tjenester for kunstig intelligens») tilbudt av GoDaddy.com, LLC eller dets tilknyttede selskaper («GoDaddy»). I tillegg er din bruk av tjenestene for kunstig intelligens underlagt GoDaddys avtale for allmenne tjenestebetingelser, globale personvernerklæring, databehandlingstillegg og alle gjeldende produktspesifikke vilkår eller andre vilkår som gjelder for siden du bruker for tjenestene for kunstig intelligens (samlet, med bruksbetingelser for kunstig intelligens, «Avtalen»). Ord med store bokstaver, men ikke definert, i bruksbetingelsene for kunstig intelligens har betydningene gitt andre steder i Avtalen.

2. Generelt innhold

Du kan levere inndata til tjenestene for kunstig intelligens («inndata») og motta eller bruke utdata fra tjenestene for kunstig intelligens som er basert på inndataene («utdata»). Inndata inkluderer, men er ikke begrenset til, all tilbakemelding, instruksjoner, informasjon eller oppfordringer som du gir som en del av tjenester for kunstig intelligens. Inndata og utdata er samlet ansett som «innhold». Du er ansvarlig for alt innhold, inkludert å sikre at det ikke bryter med noen gjeldende lov eller disse KI-bruksbetingelsene eller andre vilkår i Avtalen eller krenker en tredjeparts immaterielle rettigheter, publisitet-, personvern- eller andre eiendomsrettigheter. 
GoDaddy eier eksklusivt alle rettigheter, tittel og interesse i og til tjenester for kunstig intelligens og andre tjenester (som definert i Avtalen om Allmenne tjenestebetingelser) og ingenting i disse KI-bruksbetingelsene skal anses som å gi deg noen eiendomsrettigheter i tjenestene for kunstig intelligens.
Som mellom deg og GoDaddy, og i den grad det er tillatt i henhold til gjeldende lov, (a) beholder du dine eierskapsrettigheter i inndataene og (b) eier utdataene. I den grad det er tillatt i henhold til gjeldende lov, tildeler vi herved deg alle våre rettigheter, titler og interesser, hvis noen, i og til utdataene.
Vi kan bruke Innhold for å tilby, opprettholde, utvikle og forbedre våre tjenester, overholde gjeldende lov, håndheve våre vilkår og retningslinjer, for å markedsføre og annonsere våre tjenester og holde våre tjenester trygge. 
Du erklærer og garanterer at du enten eier fullt og eksklusivt eller har alle nødvendige rettigheter, lisenser, samtykker, autorisasjoner og tillatelser for alt materiale som brukes som inndata.

3. Output

Use of our AI Services may, in some situations, result in Output that (i) does not accurately reflect real people, places, or facts or is otherwise inaccurate, misleading, or false; (ii) may infringe a third party’s, intellectual property, publicity, privacy, or other proprietary rights; (iii) may be objectionable or contain bias; or (iv) violates the law. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice, or to be non-infringing, unobjectionable, or fully in compliance with the law. 
GoDaddy also does not review the Content for accuracy, bias or intellectual property, publicity, privacy, or other proprietary rights clearance. GoDaddy makes no representation, warranty or guarantee as to the accuracy or reliability of the AI Services or whether the Output may infringe on third-party’s intellectual property, publicity, privacy, or other proprietary rights. 
By using the AI Services or the Output, you understand and agree:
1. Output may not always be accurate. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice.
2. You must perform a human evaluation of the Output to ensure accuracy, truthfulness, and appropriateness for your use case before using or sharing Output from the AI Services. 
3. Our AI Services may provide incomplete, incorrect, offensive, or biased Output that does not represent GoDaddy’s views. You should always review, and when necessary revise, the Output to ensure accuracy and truthfulness and remove any offensive or biased materials. If Output references any third party products or services or expresses any views, it doesn’t mean that GoDaddy endorses the third party or is affiliated with GoDaddy or the views reflect GoDaddy’s views.
4. Outputs may not be unique across users and the AI Services may generate the same or similar Outputs for other user.
5. You must not remove or alter any AI related or other disclosures incorporated by GoDaddy into the Output.

4. Auto-Publish

The AI Services may offer features where Output is automatically posted directly onto your website, blog or your accounts on third party social media platforms (collectively, “Your Properties”) without any human intervention (“Auto-Publish”). If you consent to use Auto-Publish, you acknowledge and agree that:

GoDaddy has no control over the Output and does not review any Output prior to or after it is posted to Your Properties;
GoDaddy will provide you with a notice prior to Output being published to Your Properties to cancel or change the Output. If you do not cancel or change the Output pursuant to such notice, you are authorizing publication of the Output and the sole publisher of the Output. 
You will review all Output immediately after it is posted by the Auto-Publish to Your Properties and immediately remove any inappropriate content, including but not limited to content that is  defamatory, inaccurate, or infringes a third party’s rights or terms.; and 
There are inherent risks in the use of artificial intelligence and you are fully and exclusively responsible and liable for all Output that the AI Services post on Your Properties.

5. User-Facing Bots

AI Services may offer features that enable you to deploy automated communication tools (“Bots”) that will autonomously interact with users of your website (“your customers”) on your behalf and without human intervention. These Bots will provide responses to your customers using “your information,” which includes but is not limited to your website content, policies, information that you provide to GoDaddy, publicly available data, and feedback and instructions that you provide to the Bots. If you consent to the use of Bots, you will be deploying the Bots on your website and you acknowledge and agree that: 

You are solely responsible for the accuracy of your information.
You are solely responsible for reviewing all Bot responses to your customers and for providing accurate feedback and instruction to the Bot. GoDaddy does not review Bot responses or provide instruction or feedback to the Bots on how to interact with your customers. 
You remain fully responsible for all Output made by a Bot to your customers. 
Bots are not qualified to replace professional services and you will not make any representations or claims that could lead your customers to believe that a Bot can provide such professional services. 
While the Bots will draw from your information, feedback, and instructions as outlined within this section, Bot responses may contain erroneous or outdated information. Such erroneous responses could include promises, offers, claims, or other representations to your customers on your behalf that you may be required to stand behind. By agreeing to deploy the bots on your website, you fully and exclusively accept these risks and acknowledge that GoDaddy will not have any responsibility for erroneous Bot responses.

6. Third-Party AI Technology

GoDaddy may use technology provided by third-party service providers to provide AI Services (“Third-Party AI Technology”). Notwithstanding anything to the contrary contained herein, you authorize GoDaddy and such third-party service providers to store and use your Input for the purposes of providing you with the AI Services, to review Inputs and Outputs for abuse or misuse, and to develop and improve the services and products of GoDaddy and such service providers’ Third-Party AI Technology, including as part of the design, training and development process for machine learning models. GoDaddy assumes no responsibility for Third-Party AI Technology. By using the AI Services, you expressly release GoDaddy from any and all liability arising from your use of any Third-Party AI Technology. 

7. Avslutning og suspensjon

8. Compliance and Prohibited Uses

GoDaddy makes no representation, warranty or guarantee that Output or your use of AI Services will comply with any legal requirements that are relevant to you or your business. You are solely and exclusively responsible for all Output that you obtain through AI Services and for complying with all laws and regulations that apply to your use of AI Services, including but not limited to any disclosures or terms that need to be provided to your customers. 

You must not use AI Services to engage in conduct that is unlawful, harmful, abusive, inappropriate or is otherwise contrary to the terms of the Agreement. You must not Input or use AI Services to generate Prohibited Content.  

9. Ansvarsfraskrivelser

DU BEKREFTER OG GODTAR SPESIFIKT AT UTDATA AV TJENESTENE FOR KUNSTIG INTELLIGENS IKKE ER VURDET FOR NØYAKTIGHET, FORSIKTELSE, FORKLARBARHET ELLER RETTIGHETER FOR INTELLEKTUELL EIENDOM. GoDaddy ERKLÆRER IKKE OG GIR INGEN GARANTIER FOR AT TJENESTENE FOR KUNSTIG INTELLIGENS GIR NØYAKTIGE ELLER PÅLITELIGE UTDATAER ELLER HAR FEILFRI YTELSE, INKLUDERT (MEN IKKE BEGRENSET TIL) HVORVIDT UTDATA FRA TJENESTENE KAN KRENKE, VÆRE I STRID MED ELLER OVERTRE ÅNDSVERKSRETTIGHETER TILHØRENDE TREDJEPARTER.

DU AKSEPTERER OG GODTAR AT ENHVER BRUK AV UTDATAER FRA TJENESTENE FOR KUNSTIG INTELLIGENS ER PÅ EGEN RISIKO, OG DU VIL IKKE STOLE PÅ UTDATAENE SOM ENESTE KILDE TIL SANNHET ELLER FAKTAINFORMASJON, ELLER SOM EN ERSTATNING FOR PROFESJONELL RÅDGIVNING.

DU BØR SØKE UAVHENGIG, PROFESJONELL, RÅDGIVNING FØR DU BRUKER UTDATA SOM ER GENERERT AV TJENESTER FOR KUNSTIG INTELLIGENS.

10. Ansvarsbegrensning

IKKE UNDRE NOEN OMSTENDIGHET SKAL GoDaddy, DENNES LEDELSE, STYREMEDLEMMER, ANSATTE, AGENTER ELLER TREDJEPARTS TJENESTELEVERANDØRER VÆRE ANSVARLIG OVERFOR DEG ELLER NOEN ANNEN PERSON ELLER ENHET FOR ERSTATNING FOR NOEN DIREKTE, INDIREKTE, TILFELDIGE, SPESIELLE ELLER FØLGESKADER ELLER STRAFFEERSTATNING, INKLUDERT ERSTATNING SOM KAN FORÅRSAKES AV UTDATA FRA TJENESTENE FOR KUNSTIG INTELLIGENS.

I TILLEGG BEKREFTER OG GODTAR DU SPESIFIKT AT IKKE UNDER NOEN OMSTENDIGHETER SKAL GoDaddyS TOTALE SAMLEDE ANSVAR I HENHOLD TIL TJENESTENE FOR KUNSTIG INTELLIGENS ELLER ANDRE UTDATAER SKAPT VED BRUK AV TJENESTENE FOR KUNSTIG INTELLIGENS OVERSTIGE $10 000,00 AMERIKANSKE DOLLAR.

DEN TIDLIGERE NEVNTE ANSVARSBEGRENSNINGEN SKAL GJELDE SÅ LANGT LOVEN TILLATER DET, OG SKAL FORTSETTE Å GJELDE OGSÅ ETTER OPPSIGELSER ELLER UTLØP AV DENNE AVTALEN ELLER DIN BRUK AV DETTE NETTSTEDET, TJENESTENE FOR KUNSTIG INTELLIGENS ELLER ANDRE TJENESTER DETTE NETTSTEDET TILBYR.

Oversatte versjoner av juridiske avtaler og policyer er oppgitt utelukkende av praktiske hensyn for å gi bedre lesbarhet og forståelse i forhold til de engelske versjonene. Formålet med å oppgi oversettelser av juridiske avtaler og policyer er ikke å inngå en juridisk bindende avtale, og de erstatter ikke den juridiske gyldigheten til de engelske versjonene. I tilfelle tvister eller konflikter, regulerer uansett de engelske versjonene av juridiske avtaler og policyer vårt forhold, og de vil ha forrang over vilkårene på andre språk.
